回複：EB1被錯誤的當成NIW處理了，是不是485最後一定會被拒

 

我老公的NIW EB2已經approved了, PD是12/07/2010。今年初，他又申請了EB1B, 今年3月底approved了。今年4月29號老公連同我的I-485一起交上去了，I-485上的PD寫的依然是2010年12月，而不是今年3月（我們當時就有點懷疑搞錯了） 。 5月份的時候，我們都收到了EAD combo卡和打指紋通知，結果就我的指紋兩次沒過，我的case 被單獨轉到了local office, 我被要求去interview due to failure of fingerprint. 之後跟他們提供了居住地的無犯罪記錄證明，之後收到了local office的 回複說 我的visa number not available, 因此已將我的case寄回到tsc去了。 上個月，我的case作了個SR，收到tsc的回複上麵寫的是我是 employed-based secondarycategory, visa number not available。我懷疑他們把我們的cases錯當成我老公以前的NIW EB2了，而不是今年3月份的EB1b。

這種情況我們該怎麽辦啊，我們的EAD卡還有效嗎？

綠卡方麵我們可以做些什麽呢, 485會被拒嗎？-No. You may go to the USCIS local office to check your case status and ask them for help. Also write a response letter to tsc的回複 to explain that your I-485s were filed based on EB1B I-140 which priority is current (visa number available) by providing the copies of your EB1B I-140 approval notice and the I-485 filing receipts.
