我去年辦的，情況和你一樣，律師忘記了。他覺得我不用申請，h1b 一批，我們自然就是h4 了。-It is not true.


我當時也過期了。也準備出去辦。後來律師給補辦了一個深情，交了200多刀，很快就批了。還寄了797還有我和孩子的i-94. 你先別急走。我明天再看看我過去的紀錄，告訴你詳細一點。
-You were very lucky to have a considerate IO dealing with your 補辦 application. But no everyone has your luck and if the case was denied (it is in most cases), you would have been unlawful presence for > 180 days which will cause you a lot of trouble. So, for safe reason, I still suggest to go to China to get  the H-4 visa to come back.
