回複：I-864， I-485 及 I-765問題請教8老師及皮匠等各位大俠。歡迎任何回答。

我的情況為：

我配偶為綠卡持有者，我為H1B持有者。我同時進行了基於工作的EB2與基於綠卡申請配偶的F2A兩份綠卡申請，遞交的I-130（F2A）與I-140（EB2）均approved，但都正在等排期。現在我配偶為我申請的親屬F2A綠卡（I-130）下個月即將到排期，我們準備自己遞交I-485等材料，但在填寫I-864, I-485，I-765表格中遇下以下問題。

 

A. 有關I-864（Rev. 03/22/13, Expires 03/31/2015） 的問題。

1)      由於我配偶沒有工作，因此幾乎沒有收入，但三年來我們都是聯合報稅，因此，我準備用我自己的收入來Sponsor 我自己，但是不是也要以由我配偶的來填I-864，然後以家庭成員的身份來計算我的收入來sponsor

我自己？-Yes.
 

2)      基於1）我配偶提交I-864，以家庭成員的身份來計算我的收入，I-864中的“Part I. Basic for Filling Affidavit of Support”是否就應該選“1.a. I am the petitioner. I filed or am filing for the immigration of my relative.

-Yes.
 

3)      由於隻有我自己要提交I-485（沒有其它家屬），I-864的“Part 3. Information on the Immigrant(s) You Are Sponsoring”的“1. I am sponsoring the principal immigrant named in Part 2”是否就應該選“Yes”，然後其它留空，隻在第7項的“Enter the total number of immigrants you are sponsoring on this form from Items 1 through 6”中填“1”？-Correct.

4)      I-864的“Part 5. Sponsor’s Household Size”的“Persons you are sponsoring in this affidavit: 1. Enter the number you entered on line 7 of Part3.”是否必須秒抄寫上麵的數字“1”？-Yes.

 

5)      下麵矛盾出來了。I-864的“Part 5. Sponsor’s Household Size”的“Persons NOT sponsored in this affidavit: 3. If you are currently married, enter “1” for your spouse”按理說應該填“1”。

-Leave it blank here because you are the spouse sponsored, not "Person Not sponsored..".


但由於本項專門用大寫通知“

Your Household Size – DO NOT COUNT ANYONE TWICE ”，如果填“1”，我（spouse）就被重複統計了，下麵“8. Add together lines 1-7 and enter number there. Household size:”就會多1人！更何況，從排版來看，Part 5的Item#3是歸在 “Persons NOT sponsored in this affidavit”之下，但spouse（我）顯然屬於被sponsored的惟一人選，此項該如何填？難道不理會“If you are currently married, enter “1” for your spouse”而直接填“0”？

 

 

6)      I-864的“Part 6. Sponsor’s Income and Empolyment”中的Item 6～9，從排版上來看，應該屬於“Income you are using from any other person who was counted in your household size, including, in certain conditions, the intending immigrant…”即除去申請兼sponsor（我配偶）以外的其它人。但在I-864的Instruction第5頁最後幾行卻說：“Take your annual individual income from Item Number 5, and enter it on Item Number 6.c. If this amount is greater than 125% of the Federal Poverty Guidelines for you household size from Part 5., Item Number 8., you do not need to include any household member’s income.”從Instruction來看，Item#6.c 又應該複製Item#5中的“5. My current individual annual income is”（已填了我配偶的年收入，隻有幾千，遠不夠），這於上麵相矛盾！對於我配偶的年收入不夠的情況，Item#6.c還應該複製Item#5中的數字嗎？

 

 

7)      另外一個更大的矛盾又來了。I-864的Instruction不再提Part6, Item#6.c的事，開始說明如何填Part6, Item#7~10。I-864的Instruction原文為“To determine the filing requirements for you relatives included in Part 6, Item Number 7.~10., follow these instruction: b. If you included the income of the intending immigrant who is your spouse (he or she would be counted on Item number 7, of Part 5.)….”，但Part 5, Item#7卻講的是sponsor的“siblings, parents, or adult children”與spouse沒有任何關係！更何況，從排版來看，Part 5的Item #7是歸在 “Persons NOT sponsored in this affidavit”之下。而“the intending immigrant who is your spouse”顯然應該屬於“Persons you are sponsoring in this affidavit”，即已經包含在了Part 5, Item#1之內了。這到底該如何填寫？我H1B的收入應該填在Item#7.c還是Item#6.c?

-Put your information in 6.a to 6.c of Person 1. Then, choose "12" of Part 6 and fill your name there.

 

8)      按I-864的要求，支持材料中至少包含最近一個的稅表與所有W2及1099表，是否意味著要銀行及股票等所有的1099表都要複製後寄過去？
-Yes  for the ones of 2012

 

B. 有關I-485（Rev. 01/18/11, Expires 01/31/13)的問題。

9)      1.“Part 1. Information About You” 中的“A#(if any)”問題。在我們接到的“I-797,Notice of Action” for I-130上沒有任何與我的A#有關的信息。但在我們接到的另一份“I-797,Notice of Action” for I-140上有“BENEFICIARY Annn nnn nnn”字樣，字母“A”後共9個數字，每3個為一組，組間用空格隔開，這個是否就是“A#”，這個I-140 approve notice上的“Annn nnn nnn”要填到為I-130而填的I-485嗎？
-Leave it blank.

10)  “Part 2. Applicvation Type”，基於我們的情況（F2A I-130到排期），是否應該選“a.”（I am applying fro an adjustment to permanent residents status because: An immigrant petition giving me an immediately available immigrant visa number that has been approved.
-Correct. Then, provide the copy of the I-130 approval notice.

11) “Part 3. Processing Information”中的“In what status did you last enter?”中，我是否可填“J1 Exchange Visitor” （我自從以J1身份入美國境後從未離開過美國，中間申請了2年回國服務的Waiver後又轉成現在的H1B），或隻填“J1” or “Exchange Visitor”

-Correct.

12) 由於我曾經為J1身份並Waiver了回國服務2年的限製，是否必須附上每次的2019表，Wavier批準通知及H1B批準及延期通知，以證明我的身份一直合法，沒有Gap?

-Correct. Also provide the copies of all I-94s (J1 and H1) and your recent 3 months paycheck stubs.

 

13) “Part 3. Processing Information”中的“Current Occupation”是否必須與我遞交I-140中材料中所寫的完全一致，

-Correct.
 

盡管這個

I-485申請是為不I-130, 而是為I-140，但我想移民局可能會調查所有我遞給他們的材料。

 

C. 有關I-765（Rev. 08/15/12, Expires 02/28/2013)的問題。

14) “I am applying for:”是否應該不選？因為它好象列在了“Do not write in this block”大項內。但從內容上看，又應該選上。如果應該選，以我的情況，應該選哪個？第一項“Permission to accept employment”嗎？
-Correct. You may not need to apply for it if you will use H-1 to work.

15) 第“5. Place of Birth(Town or City) (State/Province)”中，對於中國大陸過來的，“State/Proince”是隻填 “xx

省”還是要
 

“xx市/xx省”？

-Yes plus China.

16) 第“14. Manner of Last Entry”中，是填“J1 Exchange Visitor”-Yes.
 

或“J1” or “Exchange Visitor".

17) “15. Current Immigration Status”，是填“H1B Temporary Worker

”-Yes or just "H-1B".
 

或“H1B”或“Temporary Worker”
