我想谘詢一下FOLLOW TO JOIN的問題，先生是加拿大籍華人，今年2月綠卡拿到。 我們是去年年初在他PD CURRENT以後結婚的。我是中國籍。目前在中國。 想谘詢以下問題

 

1） 是不是我們需要走FOLLOW TO JOIN這個程序，他填寫I-824表格？

-Yes if you can not enter US using a non-immigration visa.

 

2） 除了I-824外， 先生還需要提供什麽文件，資料及相關證明公證文件？

-Copy of your marriage certificate, copy of his green card, copy of your birth certificate and other required documents based on the I-824 Instructions. After the I-824 approval, USCIS will forward the approved I-824 to the National Visa Center (NVC) and then, NVC will contact your spouse and send him the instructions. Then, he just needs to follow the NVC Instructions to provide what NVC ask.

 

3） 因為我們都是二婚， 他在提供資料時是否要有離婚公證等相關信息？ 雖然這個信息在他綠卡申請階段早就提交過？

-Yes, both of you need to provide your 離婚公證.

 

4） 在先生提交資料的階段， 作為配偶，我需要提供何種文件資料？

-See above.

5） 在他替我申請時， 是否可以不用請律師，我們按照USCIS的網站提交資料給加州移民局即可？

-Not need a lawyer. It is simple procedure,

6） 在何種情況下會導致他申請被拒？

 

  我們在申請材料之外是否要提供任何附件資料，比如照片， 比如我們的相聚的出入境記錄等以加深移民官我們夫妻有正常探望的記錄。

-Not now. May need this kind of information during your immigration visa interview.

 

7） 如果因為部分資料缺少， USCIS是否會發出補件要求， 這樣的準備時間一般多長？

-Normally one month to repsond to the RFE.

 

  如果因為第1次遞交材料缺少是否容易導致拒簽？

-No.

8） 如果在美國收材料正常， 一般多久可以轉到廣州使館？ 如果整個流程正常的話， 從先生遞材料被收取起， 到我的簽證下來，總時長大概需要多長時間？

-Normally one year, case by case.

  看網上寫的資料大概是1年半？ 不知道是否是這麽長時間？

-It is possible.

9） 如果USCIS收了我開始移民的材料，我是否就不能辦理B1/B2簽證去美國看望我先生，

-Correct.

  即使我去中信銀行辦理簽證，也會因為我的狀態由非移民改為移民，導致探親簽證被拒？

-You may try to get the B2 visa to enter US, then, file I-485 directly 3 months later after you enter US. If so, not need to file I-824. If you can not get the B2 visa, then file I-824 to apply for the immigration visa in China.

準備材料中，希望得到老師們的指導，可以順利和先生團聚。
