My 6th H1B will expire in Nov.2013 and only 9 months left.And I have I-140(perm) approved through my current company A. I got an offer from another company B, but its attorney told me that if transfer my H1B to new company B, I can only transfer the remaining time (9 months), so my offer will be canceled.
-The lawyer is completely wrong (normally company hired lawyers are very poor because it is cheap). Base on AC21 106(c), you can do H1 transfer/extend your H1 for another 3-years beyond the 6 year limit using the approved I-140 no matter which employer you work for. But if your current employer (I-140 sponsor) withdraw this I-140, you can not use it to extend your H-1 anymore.
I wonder if the attorney is true, or I should get 3-year H1B since I have I-140 approved. And where I can find the policy/documents to show to the attorney?
