請教8老師和其他高人，H1-B延期批複, EAD及相關問題

本人情況： H1-B 8月10號到期，我7月底向公司及律師遞交了延期申請材料，USCIS Receipt Date 8月25號.

 EAD 和 AP 2013 年2月1號到期。EAD    Renewal 申請Receipt Date 11月5號，AP   Renewal 申請  Receipt Date 11 月25號。 

10月份回國一次，用AP回美國。之前專門谘詢了律師是否需要撤銷H1-B 延期申請，答複是不會有影響。 

昨天收到H1-B   Approval Letter.  Notice Type: Approval Notice. Consulate: Shanghai 

但是在下麵一段寫明： The above petition has been approved for the classification requested. It has been determined that the named worker is not eligible for the requested extension of status.

Since the worker has been found ineligible for the extension of stay, we have sent notification to the consulate shown above. If you have any questions about visa issuance, please contact the consulate directly.

If a visa is issued, upon admission in this classification the worker will be authorized to be employed by the petition for the authorized period pursuant to the terms and conditions of the petition.

 律師的解釋是：

                As you can see from the attached Approval Notice, your H-1B Petition was approved. 

                However: as stated in the 1st paragraph of the notice, the extension of stay, unfortunately, was              not granted, due to your re-entry into the United States (October 2012) pursuant to your      Advance Parole. 

 

想問的問題：

 

1. 我現在還能合法在美國工作嗎？

 

2. 這個H1-B 批複是什麽意思？ 我現在要到上海去申請簽證嗎？

 

3. 擔心2月1號前，EAD申請是否能批下來。 如果到2月1號，EAD Renewal 還沒批下來， 我還能合法在美國工作嗎？

 

4. 律師的解釋是因為我10月份用了 AP, 所以 “ the extension of stay was not granted”。 我翻了壇子上之前的帖子，覺得是因為H1-B 延期申請日期 （8月25號）超過了之前的有效期（8月10號），不知理解是否正確？

 

5. 我現在應該怎麽辦？
