我是H1B,我的EAD(出生日期有錯誤,USCIS說可以寄回更換,幫忙申請EAD的律師說不影響使用---隻要雇主接受)在手上,

1. 假如我從這個月用或下個月用EAD,我的明年繳稅將受何種影響? 比如今年前十個月的稅一定要按H1B的收入要求標準工資來繳稅嗎? 還是可以用今年的實際收入(少於H1B要求)來繳稅?
-Haven't you file tax return before? Tax return always use your actual income, not H1B income.
2. 或者我繼續用H1B不用EAD,而明年繳稅用今年的實際收入(少於H1B要求),那麽我的GC( I-485pending )會受影響嗎?
-No. As long as your I-140 sponsor show to USCIS that the employer has the ability to pay at the prevail wage for PERM (not H1), your I-485 will be fine (not need to pay you at that level before you get the green card).
有多大的可能性被審計?
3. 我老婆(I-485 pending)在中國,假如我用了EAD,她可以從中國申請AP嗎?
-No.
-- 其實她的AP已經批準,但是寄丟了,回中國之前沒有收到.
-She has to find it and use it to return to US. Otherwise, she needs to apply for the H4 visa. Therefore, you can not use EAD, otherwise she can not get the H4 visa.
