I have both H1B and EAD, both are valid.Initially I prefer to keep my status on H1B since it still has two years to go ... I received my EAD this May. When I traveled back to the US later by air, I used my H1B,and presented it to the border officer. He didn't say anything, and gave me H1B stamp on my passport. However, yesterday when I came back to the US by car, the border officer said the systems show I have an EAD/AP card, and he insisted that I had to enter the US using my EAD/AP card instead of H1B. SO he took my I-94 card away, and let me in. I asked him why the border officer at airport gave me H1B status? He couldn't understand it, and gave no answer to my question. QUESTION: Which status should I use in the US to my best interest?
-Your status is parolee now, but you still can continue to work for your employer without using EAD just like you have worked with the H-1 status.
For example, if I want to get married before GC is granted. Can Ire-enter the US using H1B?
-Yes. You can go outside US and reenter US using an H-1 visa (or your passport with your H-1 approval notice if you are a Canadian citizen) to return to your H-1 status. You can also extend your H-1 status within US to reinstate your H-1 status.
