legal status of 458 applicant with removal order

My friend had a removal order in 2004.He submitted I485 as spouse of US citizen in August 2012 and received the 485 acceptance letter. He also did fingerprint on Sept 4, 2012, and received a request for medical exam report 10 days ago. So is he legal to stay here? An expert in this forum said that he would be denied soon after the fingerprint. But he got the request for medical exam report after the fingerprint. So it will take a long time for USCIS to deny his I485? Thank you for any advices.
