Did they get green cards and citizenship? If they did, congratulations.

You are right, INS will not trouble itself since immigration law declares that the beneficiary takes the responsibility to their legal status, not INS.

But they will trouble you when you apply for GC and citizenship later. Nobody wants to be in that situation, right? And there will be no way to get a waiver.

Since there is no exception for Chinese J1 because of treaty between US and China, no matter what's written in your visa, why not get a waiver during J1 period? It's easy to get. Why keep some potential trouble to the future?
