I was B1, then changed to H1 I-94, Tijuana gave me H1 visa. So far as I know, you should be no problem as long as you got H1 approval (I-797?), and all papers I mentioned above. Some people say you should be able to return back US right away even they decide background check( I am not sure about this). According to what I saw in consulate, I GUESS all H1 got approved, because almost all asian guys got visa, and I assume most of them were applying for H1. Before I decided to go there, I struggled a long time, now I think every case is different, there is alway a risk. you should make a decision based on your own situation.
