8老師,之前在論壇上問過您幾個問題,得到您的幫助,多謝.現在有了一些更新,想再請教一下.

五月初的時候老公被雷,我4月30號的時候file h4轉F1,LD緊接著file了 H1b轉F2. 8月6號移民局網上顯示我們倆的轉身份申請都被批準了,今天收到了approve notice,兩份notice上都給了新的I94,notice date是6號,但I94是valid from 08/12/12 to DS, 請問一下這種情況,我們8月6號到8月11號期間算gap嗎?

-Both of your status are fine because you filed the applications before your H1/H4 was invalid and that is why UISCIS approved both of your applications (with new I-94).

有了新的I94,還需要出境激活什麽的嗎?

-Nothing needed to do.

另外,老公已經找到了新工作,是不是13號的時候就可以file F2轉H1b?

-Yes, he can do it now. I suggest that his emplpoyer use premium processing to get the H1 approved in 15 days so that he can work earlier.

還是需要去墨西哥一趟,拿著新的轉H1b的797和原來的未過期的H1b visa (9月5號過期)再次入境一下?

-Because his F-2 was approved, I believe his H1 application will be approved with the I-94. Thus, he does not need to go to Mexico and just work after the H1 is approved.
