-Yes, technically. But the rpoblem is that your new I-20 start date will be later than your H1 start date due to the Fall Semester is in the Mid- or late Aug, and thus, your new I-20 may not solve your problem.
Thank you once again for your help, Teacher 8. I really appreciate it. I was told by Kaplan GMAT for International Students that they will be able to issue an I-20 that will start on August 6. So my questions are:
(1) If my H1B will start on a date later than that date, say August 15, would that solve the problem?
-The problem is that your F-1 grace period will end before your new I-20 effective date and that means you will be out of status after that date. The new I-20 issued to you can make you legally stay in US, but you do not have a status until the new I-20 effective and you actually enroll that school, then you have an F-1 status again.
So, if you file H1 petition after your F1 grace period ends and before your new F-1 status is effective (you do not have a legal status in this gap), your H1 petition will be approved, but it will have no I-94 and thus, you still need to go to China to get the H1 visa to come back to work. So, the new I-20 is not helpful to you.
(2) And also it is technically possible to ask my employer or lawyer to set the H1B starting date on August 15? (The school starts around August 18th.)
(3) Finally, would the closeness between the starting date of a new I-20 and that of H1B cause any suspicion that would delay or prevent the approval of H1B?
