各住老師好!我有一份niw的140已批準, 而且用它做了h1b六年之後的延期,現排期到已交了485,但還保持h1b身份,如果485被拒,我的已批準的h1b在還沒到期的情況下是否也同時失效了呢?

如果再申請一次140,批準後還可用這份被拒過的485的140的pd嗎?謝謝!

-YOu don't need to file another EB2 I-140. YOur NIW I-140 is still valid even if your current I-485 is denied and you can use it to file your I-485 again. Also, you can continue to renew your H1 beyond the 6 year h1 limit using the currently approved NIW I-140.
