我的EB-2 I485 pending 過了180天了. LD是副申請人決定從現在的C公司跳槽去A公司.A不給H1B Transfer. 所以得用EAD工作. 要是1個月後另有B公司有意給offer並願Transfer H1B. 老師上次的回答是LD得回中國簽H1B. 可要是C公司願繼續把LD留在payroll上幾個月(contractor or part-time)直到LD能接上B公司的H1B, 這現有C公司的H1B和使用EAD在A上班有衝突嗎 (允許這樣的dual status嗎)?

-Fine beacuse you have EAD, you can work for a few employers at the same time.

如B公司Transfer H1B時LD還在C公司的payroll上, LD還得回中國簽H1B從而到B公司上班嗎?

-If the H1 transfer approval has the I-94, you do not need to go to China to get the visa.
