both my mom and my step-father are in china now. my mom's green card just approvl last week. i want to invite my step father for short visiting(B2 visa)now. since his I-130 has been rejected in 2008, do you think he will get his B2 visa this time?
-I don't know, but just try and there is always a chance. If he can not get the B2 visa, your mother can file I-130 for him as the green card holder using F2A category which may take about 3 years for him to get the immigration visa in China, but the problem is that they have to separate for a while though your mother can visit China during the period of time. If he can enter US using B2 visa, he may just stay in US illegally until your mother becomes a US citizen to sponsor him green card (this is ideal way).
He got B2 visa twice before (2000 and 2007).
