我是2009年5月的pd (NIW-eb2), 但是在10年中的時候因為家裏的需要辭了職，現在h4。原本想等勞工的綠卡，但他的pd是11年3月的，現在排氣後退，還不知什麽時候能等到他。而且他現在h1延期被rfe，我們也擔心他的h1萬一 messed up，所以現在我打算把我的485交上去。我是希望現在因為排氣後退，我的case就壓在那裏，但是可以拿到ead,給勞工一個後備，實在不行我也可以出去找工作。就是想問一下

1。 我的這個想法是不是現實。

-Yes, it is a good choice in your current situation and you had better find a job as soon as possibel in the same/simialr field as before.

2。 因為我勞工再版h1延期，表格上的current status and effective date怎麽填

-Just file H4 for you and H1 for him using the effective and expriation dates of your currrent I-94 and provide the H1 and H4 extension receipt with the I-485 filing.

3。如果現在不申請AP,將來申請還要另外角錢嗎？

-No fee for AP/EAD no matter when you file application..
