我的H1B一直到I94到期才結束是嗎?
- The principle is that after you is laid off, your H1 status is ended. But if your new employer does the H1 transfer for you before you are laid off or within one month after you is laid off, your H1 approval probably will have I-94 so that you do not need to go outsdie US to get theh1 visa.
But if you can not find a job before your current H1 I-94 expires, you will be unlawfully present from the date your I-94 expires. If your unlawful presence is > 180 days, you will be subjected 3 or 10 year bar if you leave US.
If the new position is not available May 1st the severance benefits (pay and health coverage) will bridge whatever gap there is between your last day in the lab and being hired in your new position. You will continue on the university payroll and health benefits in a new department -- (central/downtown) Human Resource Administration -- while on severance status. Upon being hired by the new employee, the Human Resource Administration department will transfer you to your new department.
