老師，我被大學LAYOFF，４月３０日最後一天工作日，５月３０日最後一張PAYCHECK，我的I－９４到八月，這種情況，我的H１B哪天過期？我現在找到大學的另一份工作，哪一天前我必須FILE H１B TRANSFER？在我H１B TRANSFER沒批之前，配偶的H４算過期嗎？謝謝 - You are considered OOS after 4/30, however if the employer files I-129 for you no later than a couple of weeks after your last paycheck, mostly your H-1B will be approved with I-94.  

Your spouse is in status as long as you're in status, and needs to file I-539 prior to I-94 expiration upon your new I-129
