請教8老師和P老師及其他有經驗童鞋：H1b 6年將到，早就計劃卷鋪蓋回國，現公司突然冒出來

現公司突然冒出來說可以再renew 3 年H1B，傻了！

09年2月被擂，當時在那個公司approved I-140 EB3現在在網上查也沒被revoked掉， PD: June,2007

之後來到現公司，給辦了H1 transfer, 但不sponsor綠卡，出於各種原因吧，沒找到也沒仔細再找能sponsor綠卡的公司。馬上6年大限到了，想著能回國陪老人家也不錯，沒覺得有太大遺憾，結果公司律師顛顛地來管我要材料renew h1b, 我跟他說沒得延，沒時間了，人家硬說可以，blah了一通。

Unless the prior employer retroactively withdrew the already approved I-140 petition, he is mistaken. In fact, we relied upon the approved I-140 petition to get a three year H-1B for him when we initially applied for H-1B status. While XXXX(現公司） cannot rely on the approved I-140 petition for the prior employer for permanent residence purposes, we can still take advantage of it for H-1B extensions, provided Mr. XXX remains ineligible to apply to adjust his status because of the unavailability of permanent resident visas. The I-140 petition was approved for a third preference professional. He is a national of the PRC. Permanent resident visas are available for third preference aliens from China with a priority date of March 1, 2005. (That will change to April 1, 2005 on May 1.) Mr. XXX’s priority date is June 12, 2007. We can therefore use the approved I-140 to extend his H-1B for another three years, unless somehow his priority date becomes current before September 2012（六年大限期）.

Theoretically, at some date in the future Mr. XXX could rejoin his prior employer in the same or similar position that was the subject matter of the labor certification application and I-140 petition, and, when his priority date is current, apply to adjust his status. He simply cannot use the approved I-140 for an I-485 application if he is not working for or rejoining the prior employer.

大意就是你反正有一份沒被revoke的I-140, 在你的PD current前，你都可以3年3年地renew h1b, 不管employer 是誰。PD current了，你可以回原公司工作，繼續遞485，辦綠卡。

請問老師，這律師哥們說得對嗎？我真是聞所未聞唉！
