老婆所在的部門被砍掉了,全部走了。她是副申請人,485已經交了。EAD/AP還沒有批
。我有兩個問題想請交一下。(先謝謝大家了)
1.如果她不轉成H-4,是不是就自動進入AOS,能合法待在美國?以後也能用EAD和AP?
2.因為的她的預產期比雇傭截至日早,所以她的公司允許她用6個禮拜的unpaid FMLA(
工資是保險公司的short-term di*****ility付)。雇傭截至日是她的FMLA結束的那天。我
們本來想這樣進行的,把轉H-4的申請在FMLA開始的時候交上去,H4生效日就是填6個星
期之後。可是昨天看了網上一個律師的話(下麵的英文),大致意思是隻有當FMLA結束
後繼續為雇主工作,移民局才能承認FMLA期間是合法的。這個是不是說我老婆這次連
FMLA都不能用了?
"the issue of whether the employee maintains H-1B status during the leave is
dependent upon whether there is an expectation of continuing employment at
the conclusion of the leave of absence. If there is -- even if the leave is
extended -- the employee is in valid status. If there is no expectation of
continuing employment, the employee is not in valid status during the leave
period."
