老師，我想請教一個問題，我是大學H１B， I１４０NIW已經APPROVED，我遞過一個I－４８５，已經打了指紋，拿到EAD和AP卡，（昨天收到移民局給我的支票，把CASH我的錢又退回來了，但是沒受到任何NOTICE，網上狀態是INITIAL REVIEW。
我現在被大學LAYOFF了，最後一天工作日是４月３０日，我去EDD申請失業救濟時，應該怎麽填才能拿到失業救濟呢？填A－NUMBER，還要填EAD卡號嗎？

-YOu have to find a job as soon as possible and do H1 transfer. If your H1 transfer approval has no I-94, you need to go back to China or Canada (if your current I-94 is valid) to get the H1 visa to come back.
我在受到I－４８５的NOTICE之前，是不是還算AOS狀態，還能合法留在美國嗎？
-Normally no one will bother you if your current I-94 is still valid.
因為是把支票退回，我猜想是移民局認為我排期不到不受理我的４８５，當時是誤收，所以把我的支票錢退還給我了。
-Do you mean you filed your I-485 when your priority date was not currrent? If so, your I-485 will be invalid and thus, you can not use EAD and AP. You can not file any appeal or MTR (you will not win it).
這種情況，我能APPEAL嗎？APPEAL其間能合法留在美國嗎？謝謝
