各位大俠，我現在非常的struggled。三年前來這個學校的時候，學校要我等三年，不讓我立即辦Special Handling，說是學校的immigration policy。那時侯沒辦法我隻能等。
現在學校同意開始幫我辦EB-2了，但是關於這個PERM的觀點，學校負責的人和我的律師竟然截然不同，導致了神仙打假，我這個凡人痛苦不堪，我這裏講一講他們雙方互不相讓的觀點：
律師：這是Regular PERM Process,主要的idea是測試勞動力市場，所以 1）這個rvruitment process不需要通過係主任（或係裏的search commitee）.2）在廣告打出去以後，如果有一個 American Citizen的申請人滿足基本的要求，那整個PERM process就fail了。所以recruitment process要比較小心，想辦法找理由來拒絕申請人，也就是最後總是這些人都不合格，所以不得不幫我辦。
學校負責人：這是regluar PERM Process,所以要1)重新進行recruitment process,重新打廣告，而且還得經過係裏，讓我的係主任負責將來phone interview的事情。2）因為我們是學校，學校有academic freedom,所以隻要學校最後說我是這個position的best candidate，那就沒有問題了，叫我別擔心。還告訴我就算是勞工局來audit,他們會有總結性的一句話：no American citizen is comparable to 我 blah blah.....
-I would just follow the 學校負責人's suggestion and it is more reasonable than what the lawyer said. The school is right that professor position is different from the regular company position and the school has the right to select the best candidate for the position, not just the one who meets the basic requirement.
