My current job is supposed to end by the end of February.  I just got a new job offer and the attorney will contact me soon to work on H1b transfer. Before I got the new job, I also prepared to change my status to F1 and paid 200 dollars online for Sevis fee. I haven't mailed the I-539 yet. 

So what do I need to do now?

-My suggestion is that you had better ask the new employer to file the H1 petition before you finish your current job or within one month after you finish your current job (if your old H1 I-94 is still valid after Feb. to March). Then, you just go to work for th enew employer after the H1 transfer filing (not need to wait approval).

 If my h1b transfer doesn't happen before the end of February, do i still need to file for i-539? 

-I don't suggest you to file I-539 at all because tghis will result in a problem due to the Last Action Rule. Also, your F-1 application may not be approved because the Spring Semester is the Mid, or approved too early before the new semester begins.

If I don't file for I-539, can I get the 200 dollars sevis fee back? 

-Probably not because I don't know how you claim it back.
