-If the EB1 I-140 is approved and that means all the I-485 including the child's probably will be approved and thus, the child's age will be frozen at the time he/she files I-485. If the EB1 I-140 is denied and the EB2 I-140 is appoved, the child's age can not be frozen and still running until the Eb2 priority date is current and thus, the child may face age-out problem.
B）。 針對863211回複問題，提問：
if EB1 1-140 沒批，and EB2-140 pending, 是不是這個送交 1-485 (with EB1 1-140) 能轉到EB2上。從而保證小子在21 前有合法的身分。
-You can not transfer the pending I-485 to the EB2 I-140 unless your EB2 priority date (PD) is current. But the EB2 I-140 pending time will be counted to the CSPA age, i.e.:
CSPA age = your child age at the time your EB2 I-140 PD is current - your EB2 I-140 pending time and if your child CSPA age is < 21, he can file his I-485.
