朋友的先生2005年在美國大學畢業,有6年在美工作(CPA,稅務)經驗.他所供職的公司用第三優先,替他申請labor certificate,去年10月已經批準.這種情況,我們聽說需要6年左右時間才可以拿到綠卡.

1)聽說,象這種情況,可以以第二優先,申請labor certificate,和綠卡.請問是這樣嗎?

-Yes. Bachelor degree plus five years of working experience is qualified for the EB2 if the position has such requirment, but he needs to get the sponsor of EB2 I-140 from another employer. In other words, he can not use the experience he got from the same employer who sponsors his EB2 I-140.

2)現在應該怎麽做才能最快時間拿到綠卡?

是否應該cancel現有申請(用第三優先申請的東西),然後再用第二優先重新申請?

-Not need to cancel the EB3. The filing does not affect the EB3, but can use the EB3 priority date for the EB2 if the EB3 I-140 is approved.

3)他們必須隻能通過公司的律師申請嗎?可以自己指定律師嗎?

-Depends on the employer and you.
