有的同學在當前身份失效，且沒超出 180 天的時候，認為由於有 245(k) 的保護，所以仍然可以提交 I-485. 這種認識是不全麵的。因為 245(k) 豁免的是工作移民的少於 180 天的身份違例，但是並沒有豁免當前身份失效。
在來看看USCIS的 Memorandum
其中有段文字如下
3(d)(4)(C)
Failed to Maintain a Lawful Status and/or Violated the Terms of a Nonimmigrant Visa.
(1) General. Expiration, revocation, or violation of status puts a nonimmigrant out of status, and the alien remains out of status until some adjudication restores status or the alien departs the United States.
In most cases, the 180-day counting period commences on the date the alien’s status expires, is revoked, or is violated following the alien’s most recent admission.
…………….
Consequently, if the same alien files a second application for adjustment of status, the period after which the nonimmigrant status expired and during which the first adjustment of status application was pending counts against the 180-day period when considering eligibility for relief under 245(k) in the adjudication of the second adjustment of status application.
“身份違例”不就是“OOS”嗎？OOS不向USCIS要個身份，OOS就保留至當前。怎樣理解您的“身份違例”同時還不“當前身份失效”？

下麵是 245(k) 的兩個例子：
王五是 H-1B 且 I-140 的受益人，在上一次入境之後曾被 lay off 了仨月/或曾打第二份零工四周，但是現在是在依 I-129 為該雇主工作。王五現在可以交 I-485.
王五同上，太太是 F-1，但是日感學習壓力頗重，上個學期隻上了兩門課（F-1 全日製學生要求注冊三門課），現在是三門。王五太太現在可以交 I-485.
王五的例子中，USCIS可能不知道王五曾被lay off了仨月，因為雇主沒報告USCIS,王五自己也不提. USCIS也不知道王五曾打第二份零工四周，因為沒有1099-MISC或W-2. 或者王五還有個part time的H-1B用於打零工. 王五現在當然可以交I-485,根本不需245(k).不然的話，王五從他被lay off的那天起，或從他打第二份零工的那天起，就OOS了，並OOS到當前。他之所以現在可以交I-485,是因為他OOS還沒滿245(k)中的180天。根據USCIS的Memorandum

王五太太的例子中，上個學期雖然隻上了兩門課，也許她事先征得了International Student Advisor的書麵許可。王五太太現在當然可以交I-485,根本不需245(k).不然的話，她從上個學期起就OOS了。她之所以現在可以交I-485,是因為她OOS還沒滿245(k)中的180天。根據USCIS的Memorandum
她是violation of status了，violation of status puts a nonimmigrant （F-1）out of status, and the alien（她） remains out of status （當前） until some adjudication restores status (filing I-485)or the alien departs the United States.(她沒離境)。
245(k)赦免了OOS（包括Expiration, revocation, or violation of status）我的理解對嗎？請指教。
