Currently my wife is taking MS program and will have internship this summer and then graduate. She has EAD based on I485 although she has not used it. At first I hoped she could renew it from May while MTR's pending no matter it would be approved or denied. Now is it possible to renew it and then apply H1B?
-Because the I-140 was denied and I believe the pending I-485 will be denied very soon also. So, I don't suggest her to renew the EAD based on that pending I-485 because it will not work. I would suggest her to apply for the H1 driectly after she find a job.
Another question, is the time for H4 counted in the 6year of H1?
-No. She can have 6-year H1 to go.
