8 teacher, if my perm/I-140 is approved in March 2012, but the company which sponsored me will have to be merged or desolved, is my approved I-140 still valid?

-If it is merged, the new company just needs to file an I-140 amendment. But this company is closed, your I-140 is void, but you can use this I-140 priority date (PD) as your future I-140 priority date. You also can use this approved I-140 to extend your H1 status beyond the 6 year limit in either case.

if I start a new company in the US, can I hire myself and use this approved I-140 to apply EB-2?

-No, but can use its PD as your new I-140 PD. what is the eligibility for the company that I can hire myself? is there any asset, financial, employee requirement?

-Your company has to have the ability to pay you at the prevail wage level from the date of PERM filing until the date your I-485 is approved.
