1）。如485和140 同時交， EB2 140 批了， 小子得到保護，排期時， 超過21 可以嗎？
-If the EB1 I-140 is approved and that means all the I-485 including the child's probably will be approved and thus, the child's age will be frozen at the time he/she files I-485. If the EB1 I-140 is denied and the EB2 I-140 is appoved, the child's age can not be frozen and still running until the Eb2 priority date is current and thus, the child may face age-out problem.
2。如先送交140，批了再交485，是不是要等到排期日才能交485表？
-If it is EB1, the priority date may be still current for a longer time and thus, the child can apply for the I-485 any time before his CSPA age turns 21.So, if you file EB1 I-140 now when you child is < 21, your child will be OK to file I-485 any time. Of course, you may use premium processing to get the EB1 I-140 approved, then file I-485. I don't suggest your child to file I-485 together with your I-140/I-485 filing, in case if your I-140 is denied, then his I-485 will be denied and thus, he can not change his status to F1 due to immigration intent. You had better use regular filign for the EB2 I-140. The longer the EB2 I-140 pending, the better for your child CSPA age.
