My questions are:
1. If I'm lucky enough to get a new job very soon, do I use my EAD or tell the new employer to apply H1B for me.
-If your current employer withdraws the H1 before you do the H1 transfer, your H1 transfer approval will not have I-94 and thus, you need to go to China to get the H1 visa to activate your H1 status. So, you may use EAD to work first in this case and then, go to China to get the H1 visa some time later at your convenience . Anyway, not hurt you to do the H1 transfer when you find a job.
2. I've already used up 6 years H1, can I use the approved I140 to apply 3 years?
-Yes, but you have to extned it before your H1 reaches the 6 limit. So, you have to keep the paperwork you were laid off because this is the eveidence of your H1 clock stop.
3. I know I am desperate, hence I may be dreaming but if there is any way to slow the I485 process so that I can pass 180 days mark?
-Hope USCIS will not make a decision very soon on your I-485 and you can do nothing beyond that.
