Your lawer is right, because once you used your AP to reenter US, then you will have to leave US if your I-140 is denied.

So, get a H-1B visa is the best approach. Of course, if you want to bet on the approaval of your I140, you definitely can use AP.

Why not try H1 visa first? then if it fails, use your AP to come back.
