回複：急問485填寫中I-94問題

請教白兔，皮匠等專家，我把白老師的“手把手幫著填I485”讀了好幾遍，還有如下
問題(實在是班裏的差生)：

1. Part1中I-94#是填Last arrival還是current I-94#? 

-It is current I-94#.

2. 我2000年11月以J-1short term scholar來美(6個月的簽證)，到了後才知道這種
J-1簽證不能在美國境內續簽。於是2001年3月去了趟溫哥華換成research scholar
還是J-1。但從加拿大回美時沒有發給新的I-94，人家把舊的I-94又給回我，隻是蓋
了入境章“J-1 D/S”。

-Because you got the new J1 visa in Canada to enter US, your last date of entry is 2001年3月 and your I-94 issue date is the same date of your last entry.

By the way, have you never been China since 2001年3月? If yes, you do not need report the information you traveled to Canada in your I-485. The principle is that you only need to report your status maintenance since your last/latest entry to US in your I-485 filing.

請問這會不會出問題，因為那張I-94上寫的是2000年11月？

-It should be fine because the CBP officer should have updated it in the system when he/she 蓋了入境章“J-1 D/S”。

 3. 再就是485Part3中"place of last entry into the US"一項，白老師的講義裏
說以入境章為準，而我從加拿大回美的入境章上竟寫的是“U.S. Immigration, VANCOUVER,
 B.C." 以前從來沒注意過，這次填485時一看下了一跳----我能照填VANCOUVER, B.C.嗎？
(總覺得應該是美國本土的地名才對)

-It is fine to use “U.S. Immigration, VANCOUVER, B.C."  because you were inspected by the US CBP officer there.

懇請各位專家老師幫助指點迷津。好不容易排期到了，生怕填錯了485。我在此先謝

天啊，剛才等老師回複時看了一些大家關於I-94的貼子，真是讓人冒冷汗啊。時隔這
麽多年，我真記不清去加拿大時是不是忘了上繳舊I-94還是丟了新的I-94，我就呆
了五天。當時換簽證吉凶難卜，跟本沒注意I-94的事。這回麻煩了。退一步說，中
國人離境，人家會不問我要I-94嗎？

-It is fine in your case because you got the new visa and the CBP officer 蓋了入境章“J-1 D/S” on your I-94 (it equal to your new entry to US).
