申請人的情況:
1. 申請人是加拿大公民,住加拿大.
2. 申請人在A公司工作四年, 由A公司sponsor綠卡. 申請人的PERM和140都已經批準.
3. 申請人2008底被A公司LAYOFF, 後在一個月內找到現在的公司B(H1-B visa)工作至今.
4. 現排期已到,準備遞交Consular Processing(CP).
5. 現在A公司有意請申請人回去工作,並同意提供CP麵試所需的job confirmation letter.
我的問題是:
1. 如果申請人繼續留在現在的公司B,CP麵試時是否有風險?
-Techncially, it is OK.
有人告訴我: consulate have more scrutiny when your sponsor of green card is not your current employer.
-True. But if Company A support you, you will be fine.
2. CP麵試時會查什麽文件?
-The US Consulate will send you the list of required documents.
過去5年的Payroll?
-Not need such documents.
