You don't have a legal status.

If you have an employment based 485 pending, you should have a different valid F1, H1, F2 to wait for your 485 approval (that's what your lawyer meant) or work with the said employment using EAD (485 pending status). You cannot wait for your GC while doing something else (studing) without a legal status. You have been out of status for so long. Better to find a good lawyer for your case. INS could consider your case as a fraud.
