各位老師，我有些關於配偶綠卡申請的問題想請教一下
我的情況如下：
我是中國EB3，排期是06年底，485已經在07年大潮裏遞交，現在用H1B工作，持有EAD和AP，最近在轉EB2，PERM已經批準。還沒有遞交I140，準備走premium。我在遞交485後結婚，妻子原先在美用H1B工作，後來辭職返回中國工作，她是香港公民，持有uk護照。
我在考慮如何幫我妻子申請綠卡的步驟
現在有兩個選擇：
1）我妻子過來美國，等我的I-140批準後，就遞交I485。
a:我想問一下這種情況下，會不會出現在140批準後，我的綠卡在很短的時間幾天內就批了， 而她的申請還沒有被uscis收到，如果這種情況發生了， 有什麽問題麽，必須得重新走follow to join？
-It does not matter. As long as she is in US, she can file her I-485 when your PD is current no matter whether your I-485 is approved or not.
b:她什麽時候可以做移民體檢？
-She can do the physical exam any time, but can not file her I-485 until your EB2 I-140 is approved and you do the I-485 transfer from Eb3 to EB2 (your PD is current in this case).
需要等我140批準後才可以做，還是現在來美國後就可以做了？
c:我的律師和我說，我妻子拿到綠卡的時間可能要比我長不少，我如果在140批準後1-2個月拿到綠卡，她可能需要3-4個月，而不是同時拿到，根據你們的經驗需要那麽長時間麽？
-I agree with your lawyer and that is case by case.
d:她遞交完485後，可不可以回國等綠卡？如果可以回國等的話，那麽在她等待的過程中，我的綠卡被批準了，她的H4自然失效，那麽她來美國打指紋的話，入關會有問題麽？
-She had better ue AP to travel.
她的UK護照正常情況下是免簽的。
-When she use her 免簽 to enter US, her I-485 is invalid. Also, she may not be allowed to enter US due to immigration intent. Also, before she file I-485, she needs to get the H4 visa to enter US, not use the 免簽 benefit, otherwise, she is not qualified for the I-485 filing.
2）第二個選擇就是在國內走following to join或者consular processing.
a:我對這兩個有什麽區別有點糊塗。這兩者（follow to join/ CP)是一回事麽？花費的時間一樣麽？
-Using consular processing (CP) takes much longer time for her to get the GC.
b:走following to join 的話，我看到都是說半年到一年不等，這個時間取決於當地使館的處理速度還是由美國這裏的排期先後之類的決定的？
-Correct. Also, you have to wait for your I-485 approval to file I-824 for CP for her.
c:什麽時候可以遞交following to join? 是必須我拿到綠卡後， 還是在我140批準後，排期變為當前就可以遞交？
-USCIS only will process your I-824 for CP for your spouse until you get your GC. But she can file I-485 any time if she is in US.
d:在我妻子遞交了following to join(抑或consular processing）之後，還沒有拿到綠卡之前，她可以以什麽身份來美國探親。
-She has to use H4 visa to enter US to be qualified for I-485 filing, not use the 免簽 benefit,(see above).
