I've read several posting about H1B extension but still need to ask as my case is different (need 2nd extension).Below is the detail:
H1B was granted in 2005 in company A;
Moved to company B in 2006;
PERM application was submitted in 2008 and approved in 2011. During this period, H1B was approved for extension thru 7th year (May 2012).
My I-140 is under RFE review and decision is expected by Nov per notice.
My EB2 PD is May 2008.
Question: If my I-140 is approved, am I qualified to have another H1B extension given that it's already extended to 7th year?
-Yes. If your I-140 is approved before your current H1 expires and your PD is not current, you can extend your H1 again for for three years. If your I-140 is still pending at that time, you can still extend your H1 for one year. But if your I-140 is denied before your H1 expires, you can not extend your H1.
