1. so I can apply EDA without use now, then I can still be F1 OPT, right ?
2. definitely we will use OPT until last day, still will be some gap between OPT expire date(05/15/2005) and my hu*****and's first H1(06/30/2005). So should I file TWO H4, first change from F1 to H4(since my hu*****and's first H1 valid until 06/30/2005, INS may only grant until 06/30/2005), then second one will synchronize with his second H1 ? or can just file ONE, which file together with his H1 renew (around Jan 2005)
3. if his NIW is rejected, we didn' want to try other ways and will go back to China. He already put too much time for this, and we believe his case is strong enough to get it(research associate at top 3 school, dual majors, one with biology Ph.D. around 10 papers, 9 strong references including 3 Academy members, many other supporting documents.) If they think we are not belong here, then we will go back China after his second H1. I just want to have valid status to stay until last day. We always think of back to China, this may help us making the final decision.
