各位大俠好；
我今天跑了一趟USCIS的地區辦公室詢問我2007年七月28日提交的I-140和I-485申請。

我的排期是2007年七月28日，即I-140得提交日，他說當前排期是2007年四月，我還
得等多幾個月，
[1]。 我在美國有2002年美國工科碩士學位，可是為何我們公司把我歸類EB3而不是
EB2？

-Whether the PERM is EB2 or EB3 depends on the PERM position requirement, not your personal qualifications. If the position requires at least Master's degree or Bachelor plus five year experience, then this position is EB2 poistion. If the position only requires Bachelor and less than 5 year experience, the position is EB3 position even if you have Master's degree. So, you need to contact your lawyer or HR to see what kind of the PERM position is. If it is EB2 and they mistakenly indicated it as EB3, you can ask your HR or lawyer to request USCIS to fix it for you. If it is EB3 position, you can not change it to EB2. But if the employer agree to file another EB2 PERM position for you, then you can apply for it and use the original EB3 priority date after the EB2 I-140 is approved..
