1.5 years ago, my lawyer filed an appeal for my H1B denial. Now in order to submit an application for H1B petition, my new lawyer says I need to withdraw my appeal for H1B denial. My old lawyer sent the withdraw letter a week ago, but still no response. Two questions?
1. How long does it take to withdraw an appeal to AAO?
2. can I submit another H1B petition while my appeal for my earlier H1B denial is in place?
-If the new H1 petition is filed by another employer, it is fine for your new emoloyer to do that for you. But if it is filed by the same employer as the appealed H1 sponsor, the new H1 petition must be filed after the appeal is withdrawn or after AAO makes the decision on the appeal.
