The point is if you apply J1 visa, probably you will be denied since your J1 will expire in 12/31/04. If this happens, you cannot come back to US.
If you apply H1b, I remember there is a certain period (15days or 1 month, don't remember, sorry, please check either INS or US consulate) for issuing a visa before H1b start date, no visa will be issued before that period. So, if you apply H1b before that period, you will also be denied and can not come back.

Background check is not the problem now.
