If your spouse had been China during the 6 h1 period of time, the totla accumulated dates he spent in China during the period can be used for H1 extension and thus, he can extend his h1 for another 3 years beyond the 6 year limit using the approved I-140. So, talk to his employer and a professional lawyer to figure it out and file the H1 petition.
