Now that my H1B from a university will be expired soon; and I got a job offer from an industrial company, for which I will start working on Oct 1st. To fill out the gap in between, my school is willing to provide me H1B extension till Sep 30th. Therefore,
1. Does the school need to file the extension petition for me before my old H1B expiration date?
or alternatively, does the USCIS has to recieve my petition before my old H1B expiration date?
-Correct. USCIS has to receive your H1 extension petition before your current I-94 expires.
Which one is correct?
2. Does my H1B extension has anything to do with the company's filing a new H1B for me?
-No. But the compnay need to file the H1 petition before your current I-94 expires (you need to provide the old H1 approval notice with the H1 I-94 and recent 3 month paycheck stubs to the company for the H1 petition).
If the company can not file the H1 petition before your current H1 expires, you have to provide copies of the old h1 approval notice and the H1 extension receipt and the latest 3 month paycheck stubs to the company for the H1 petition.
In other words, does the company need the receipt of my H1B extension (from the shcool) as a pre-requisite to initiate filing the new H1B (from the company) for me?
