My impression is NIW and EB1A based 140 should be same and also need somebody to hire when pd is current.
- The difference between NIW/Eb1A and PERM based I-140/Eb1B I-140 is that NIW or Eb1A I-140 is not employer specific and that means your I-485 can be filed when the PD is current and as long as you find a job in the same area, and has no problem to be approved. If your I-140 is PERM based, your I-140 will be invalid when the sponsor/employer does not hire you any more unless you have filed the I-485.
The only difference is somebody not need to be some special person.
