回複：I140 sucessor-in-interest amendment pending 的時候可以交485 嗎?

今天道聽途說, 象我這種情況即使PD CURRENT了也不能交485, 因為要等140 amendment 批準了以後, 原來的PD才可以LINK 上

-Based on my undersatnding, you can file your I-485 even if your I-140 amendment is pending because I-485 filing is just based on whether the PD is current, not based on whether the I-140 is approved. You just need to provide the copy of your old I-140 approval notice and the I-140 amendment receipt with the I-485 filing. But if your I-140 amendment is denied, your I-485 will be denied also. Of course, the posiibility of the I140 amendment dinial is very small. So, talk to your lawyer.

而且還聽說這種的140 amendment不能辦加急
