In July 2007, my hu*****and filed 485 as my dependent. Later, he got his own PD and I140 approved. Since my categroy is EB3, and his is EB2, he has better chance to get Green card. My question is: does he need refile 485 when his PD is current?
-Not need. Just ask USCIS to relink/transfer the Eb3 I-485 to the EB2 I-140 when the Eb2 PD is current. You and your kid can do the I-485 relink to your spouse EB2 I-140 also.
Also, my children's 485 is based on my application, do they need re-file 485 as my hu*****and's dependent? And do I need re-file to when he get his GC? Thanks for help.
