I-140批了，外派到中國工作，如果在中國時候priority date become current, 可以自己轉consular processing,不經過公司麽？

-No. Unless the company indicated in the I-140 that you (beneficial) will apply for the immigration visa in China, the company (sponsor) has to file I-824 to ask USCIS to send the approved I-140 to National Visa Center and thus, you can apply for the immigration visa in China when the PD is current. So, if the company does not want you to apply for the immgration visa in China, you have no choice and have to file I-485 in US.

 

公司不太願意這麽做，要求回到美國回到原來的position 去file 485.
