我的h1b年底到期,需要轉成h4.我有幾個問題。麻煩知情者相告。萬分感謝!
1. 一般需要提前幾個月申請?
-As long as USCIS receives your change of status applicaiton before your H1 ends, you are fine.
2. 在申請時可否指定生效起始日期?
-No.
希望能充分利用目前的h1b :-)
-Send the applciation just in advance two weeks to one month, and thus, you can work during the h4 application pending until your H1 ends or H4 approval whichever earlier (USCIS take some time to approve your H4).
3. 如果不能指定生效起始日期,一旦h4被批準，是不是當前h1b自動失效，即便還有剩餘時間?
-Yes.
這樣的情況下是不是要立刻辭職?
-Yes.
4. 可以自己申請嗎？ 還是必須通過老公的公司律師？（公司律師一般反應比較慢，所以如果能自己申請，我們打算自己申請）
-Do it by yourself, not the company's business.
