My 485 is submitted on July 2007 (EB3 category), hold H1B currently. Our company is not doing well, don't know when the lay off will happen. I have two questions:
1.If being laid off, since my PD is still far away from cut-off date, is it possible that I will receive ref letter even my 485 has been pre-adjusted? Don't want to change job now. Our company will inform USCIS if they lay off me, so, how long the ref will be if this trigger the EVL ref?
2. Currently, I am asking company to do EB2 for me. Will this trigger ref? From pjiang's block, once I140 is approved for EB2 and PD is current, just send USCIS a letter after re-link for 485 is enough. Will the 485 will be adjust again in this case and required ref of EVL?
