8老師，請幫忙看一下LCA and I-129 questions

8 老師, DIY H-1B延期, 我又有新的問題, 特別需要您的幫助

1. 準備LCA Public Access File.  其中“a copy of the notice of posting of the LCA that includes the date of posting”， the first day of posting started when the certified LCA obtained and signed and would continue 10 days. But I just found out that “the notice must be posted on or within 30 days before the filing date. Each notice must remain posted for a total of 10 days” from the website of DOL. Would I have to ask the employer change the date back (it is not a good thing to change the “data” in the company)? Or if it is not a serious issue, do I need to make sure there has at least 10 days between the time notice posted and the time the I-129 filed?


2. In current version of I-129 (01/19/11) posted in USCIS,
   
   
   1. part 4 in page 4, question 9, “Have you ever previously filed a petition for this beneficiary”, should I check “yes” because I applied initial H-1B three years ago?
   
   
   2. Question 3, page 11, is the “subject’s name” my name and do I need to include dependent’s name and period of stay here?
   
   
   3. Part C, page 18, question 3, should I leave blank because I didn’t check “cap exempt” in question 1?
   
   
   4. Part D, page 19, should I check “no” to question a and leave b, c as blank?
